TERMS & CONDITIONS

By entering the Flypark Limited car park you agree to the terms and conditions set out below. These terms and conditions apply from the moment that you drive your vehicle into the car park and apply 24 hours a day, 7 days a week. You hereby also bind the owner of the vehicle you are driving to all these conditions and warrant your authority to do so. Flypark reserves the right to amend these terms and conditions at any time without notice.

Health & Safety

We want everyone to have a safe experience when coming to Flypark. For this we ask that all customers and visitors take extra care when moving around our site. Pay special attention to tow bars and wing mirrors on vehicles, be careful of the gardens and curbs, and when it's wet be aware that surfaces can become slippery, so be careful. Lastly we ask that you please keep your speed to 10kph to ensure the safety for other customers, visitors, and our staff.

1.  Car Park Pre-booking

1.1   A car park pre-booking is deemed to have been placed when made electronically through the Flypark website.

1.2   Provided you satisfactorily complete the pre-booking procedure and parking capacity is available for the times, dates and car park specified you will receive our email confirming your booking with Flypark.

2.  Parking Conditions

2.1   Vehicles are left in this car park at any time at the owner's sole risk in all respects.

2.2   You agree to the following rules:

  • (a) You must comply with all rules and directions displayed within the car park and any directions given to you by our staff.
  • (b) You must comply with all rules or directions displayed in the car park from time to time and with all relevant laws.
  • (c) You must not obstruct other persons or vehicles using the car park.
  • (d) You must not park in any area marked 'reserved' or 'no parking'.
  • (e) The vehicle you are parking in this car park must, be roadworthy and be able at all times to be driven under its own power and present no danger or risk to other vehicles or persons or the car park.
  • (f) Your vehicle must have current insurance throughout the period parked with Flypark. It must be insured for its full market value. We do not accept any responsibility if your vehicle is under insured and as a result you suffer a "total loss".
  • (g) You acknowledge that we are authorised to relocate your vehicle on the yard where you dropped your car off; or from this car park site to another of our car park sites. When doing so you further agree that our drivers are covered by your insurance. In the event that a driver should damage your vehicle and it is proven our Flypark driver to be "at fault" our liability is limited to your excess.

3.  Car Park Pricing Policy and Calculation of Parking Charges

3.1   All prices quoted by Flypark are quoted in $NZ.

3.2   If your car park arrival and departure times change from that specified in your booking as a result of which your parking period in the car park is greater than the parking period booked, you will be charged the appropriate fee for the additional time based on the tariff applying on the date of your departure from the car park. Currently this is $7 per day.

3.3   You must pay us all the parking charges and other costs we may incur in relation to the vehicle upon demand. We reserve the right to retain possession of the vehicle until all due charges are paid for, including any costs incurred by us in respect of the vehicle. Parking fees will continue to accrue during the period we retain the vehicle until we recover all fees and costs. If the vehicle has to be removed by us to another location, all costs will have to be paid by you. If the amount due is unpaid after 30 days, you agree that we can sell the vehicle and you agree to take steps required by us to permit us to do so.

3.4   If you pay using a credit card or other form of payment where Flypark is charged a fee we reserve the right to pass on the cost of that fee when you pay your booking.

3.5   No other charges (excepting 3.4) will be applied in respect of your booking other than services booked at the time of your booking or by subsequent agreement.

3.6   All our prices include GST.

4.  Shuttle Service

4.1   Flypark provides a free shuttle service between the car park and the main passenger terminal seven (7) days a week. Free shuttle transfer includes one transfer to the terminal and one from the terminal only. Any additional transfer requests, including us having to deliver property, Flypark has the right to charge an additional fee for this service.

4.2   You are advised that it is your responsibility to allow an adequate amount of time to transfer between your car park and the passenger terminal building using the shuttle service. We do not accept responsibility if you miss your flight or check-in because you have not allowed adequate time or if the shuttle service is delayed (for example, due to exceptional traffic or weather conditions).

5.  Force Majeure

5.1   Flypark shall not be liable for any cancellation, curtailment or otherwise caused by reason of war or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural and nuclear disaster, fire, adverse weather conditions or technical problems to transport, closure or congestion of airports, cancellation or changes of schedules by airlines, and all similar events beyond its control. Further, Flypark cannot accept responsibility where the performance or prompt performance of this contract with you is prevented or affected as a result of such circumstances beyond our or your control.

6.  Flypark's Liability

6.1   You are liable for any damage to the car park caused by your vehicle. We reserve the right to enter the vehicle and move it. You agree that we have no liability for any loss or damage caused as a result of entering and moving the vehicle.

6.2   While we shall take all responsible care, we cannot guarantee the security of your vehicle. We accept no liability for any claim by you or any other person, whether for loss or damage to you or any other person, or to your vehicles or any other vehicle, whether resulting from using the car park or being able to use the car park, from any additional services that you have requested, or from your negligence or otherwise.

6.3   We accept no liability for any loss or damage to your vehicle where you have requested additional services. Such additional services may be provided by a third party, and may require that your vehicle leave our custody or control. While we shall take all responsible care to select appropriate third parties to provide such additional services, we make no warranties in relation to the additional services they provide.

6.4   We accept no liability for any loss or damage to any article left in our custody or control. Our employees are not authorised to accept any of your possessions for safe custody except the keys to your vehicle where possession is taken at our request.

6.5   We warrant that any services provided by us will be rendered with due care and skill. We make no other express warranties in relation to the services we provide. All other warranties, representations and conditions relating to the services we provide are to the maximum extent permitted by law expressly excluded. Our total liability to you in connection with the car park shall be strictly limited to and shall not exceed that determined by reference to the Consumer Guarantees Act 1993.

6.6   You acknowledge we may deliver the vehicle to any persons authorised by you. That person must know your car registration number and be able to produce evidence of entitlement satisfactory to us.

6.7   Any complaints/disputes arising out of additional services, including car valets, or other services, must be reported to us at the time of collection of the vehicle. Where these additional services have been provided by a third party, any such disputes will need to be resolved directly with the relevant third party.

6.8   You agree to indemnify us in respect of any claim made against us arising from your use of the car park or use of the car park by anyone else with your authority.

7.  Privacy

7.1   Personal data will be treated in accordance with Flypark's Privacy Policy.

8.  Interpretation

8.1   To avoid any confusion as to the meaning of these terms and conditions:

  • "damage" includes direct, indirect, consequential and special damage.
  • "vehicle" includes its accessories and contents.
  • "we", "us" and "Flypark" means Flypark Limited, and includes any of its employees, agents and independent contractors.
  • "you" includes both the driver and the owner of a vehicle entering this car park.
  • "your vehicle" means the vehicle which you are driving, regardless of whether it is owned by you.

9.  Cancellations & Refunds

9.1   Bookings made to park your vehicle with Flypark that you then elect to cancel, which is out of Flypark control, will not be refunded. Cancellation requests for a refund are considered on a case-by-case basis. While a refund is not guaranteed we will always aim to be fair and reasonable. When a refund is approved the fee paid to Flypark will be held in credit for a maximum of 6 months to be used for a future booking.

9.2   Customers that return before the original booked return date, will not receive a refund for the unused portion of parking.

FLYPARK LTD WEBSITE TERMS OF USE

1.  ACCEPTANCE OF TERMS AND CONDITIONS

1.1   Acceptance: This website is owned and operated by Flypark Limited ("Flypark"). Your use of this website is subject to these terms of use and Flypark's Privacy Policy (together, the "Terms") and all applicable laws. By accessing and browsing this website, you agree to be bound by the Terms. If you do not wish to be bound by the Terms, please do not use this website. Flypark may modify, alter or update the Terms from time to time in its sole discretion with or without notice to you. You agree to check the Terms and to be bound by the Terms in effect at the time at which you access this website.

2.  USE OF WEBSITE

2.1   No interference: In your use of this website, you agree not to do anything that may cause undue inconvenience, disruption or offence to Flypark, or that may affect the security or operation of this website, any services offered via this website or any network or system underlying or connected to them (including without limitation, by using a robot, spider, scraper or other automated means to access this website or feature on it for any purpose).

2.2   Termination/Indemnity: Flypark reserves the right to terminate your use of this website without notice in the event that you breach any of the Terms, and in which case, you agree to indemnify Flypark against the consequences of your breach.

3.  PAYMENT

3.1   All pricing are charges stated are in NZD.

3.2   Payment methods for any goods or services offered via this site will be advised to you when you order the goods and services via this site (these methods may change from time to time). If you are using a credit card, you represent and warrant that the credit card is issued in your name and that you will pay all charges incurred through your use of the credit card (whether authorised or not). You will either make the required payment immediately, or within 14 days of confirming the transaction if you select payment by cheque or direct credit.

3.3   When completing a transaction, you will be presented with a confirmation screen verifying the transaction details you wish to process. It is your responsibility to verify that all transaction, credit card/account information and other details are correct. You should print the transaction confirmation for future reference and your files. Flypark has no liability for transactions which are incorrect as a result of inaccurate data entry or for loss of data or information caused by factors outside of Flypark's control. Flypark will not be bound by any clerical errors or omissions, whether in computation or otherwise, in any confirmation screen.

3.4   You acknowledge and agree that internet transmissions are never entirely secure, and that information you send to or through the website (including credit card information) may be read or intercepted by others, despite the processes put in place by Flypark to protect your information. Flypark shall have no liability for the interception or 'hacking' of data through the website by unauthorised third parties.

3.5   Payment card data security: Flypark uses Verifone as its payment gateway provider for processing payment card transactions. Verifone complies with the Payment Card Industry Data Security Standard (PCI DSS) to ensure the secure transmission and handling of your payment card information. All payment card data is processed through Verifone's secure payment gateway, which meets industry standards for data protection and security.

4.  WEBSITE CONTENT

4.1   Material: You acknowledge and agree that all of the material on this website, including text, images, videos, graphics, trade marks, layout, look-and-feel and any other information contained on or in this website (the "Material") is subject to copyright and other proprietary rights belonging to Flypark or its licensors. This website is for your personal, non commercial use only and you agree that nothing contained on this website grants you any licence or right to use the Material. You agree not to, in any way, copy, reproduce, republish, upload, post, transmit, distribute, store (including in electronic form) or modify the Material in whole or in part, whether in text, graphical, audio, video or executable form, without Flypark's express written permission.

5.1   Convenience only: You acknowledge and agree that links and references on this website to external websites or third party material (including advertisements) are provided to you as a convenience only. Except to the extent required by mandatory statutory provisions, Flypark is not responsible for any third party material you access on or through this website (including advertisements) and Flypark has not reviewed and does not endorse or assume any responsibility for any third party content, advertisements, or products or services offered on or available through this website or any external websites.

5.2   Arrangements with third parties: Any arrangements between you and any third party supplier that advertises products on or through this website (such as payment terms, delivery dates for products or services, warranties or representations associated with such products or services) are made between you and the relevant third party supplier. Unless stated otherwise, Flypark has no liability whatsoever in relation to these arrangements.

6.1   No liability: Flypark makes every endeavour to keep the information on this website as up to date as possible. 6.2   Not error free: Flypark does not represent or warrant that this website will be uninterrupted, error-free, free of any viruses or bugs or compatible with any other software or material. Flypark reserves the right to discontinue or suspend any aspect of the website at any time and/or substitute alternative services without prior notice.

7.1   Your information: You acknowledge that any information or material which you provide electronically through your access to or usage of this website is not confidential or proprietary, except as may be required under applicable law, and acknowledge that unprotected communication over the internet is subject to possible interception, alteration or loss. 8.1   New Zealand: Use of this website and these Terms shall be governed by the laws of New Zealand without reference to principles of conflict of laws. You agree to be bound by such laws and irrevocably agree to submit to the jurisdiction of the courts of New Zealand in connection with the interpretation or application of these Terms.

8.2   Outside New Zealand: Those who choose to access this website from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
